Welcome to Markmydigi Relay, a lead response and follow-up management platform developed and operated by Markmydigi Technologies.

By accessing or using Relay, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, you should not use the platform.

2. Use of the Platform

Relay is designed to help businesses capture, manage, assign, track, and follow up on leads from websites, Meta Lead Ads, forms, landing pages, and other connected sources.

You agree to use Relay only for lawful business purposes and in accordance with applicable laws, platform policies, and these Terms.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate and complete account information.
• You are responsible for all activities that occur under your account.
• You must immediately notify us of any unauthorized use of your account.

4. Customer and Lead Data

All lead data captured, imported, or managed through Relay remains the property of the respective customer or business using the platform.

Relay acts as a technology service provider and does not claim ownership over customer lead data.

You are responsible for ensuring that you have the necessary permission, consent, or lawful basis to collect, process, and communicate with your leads.

5. Meta Platform Integrations

Relay may allow businesses to connect Meta platforms including Facebook and Instagram Lead Ads.

By connecting Meta integrations, you confirm that:

• You have authority to connect the relevant Meta Business, Page, or Lead Form.
• You will use lead data only for legitimate business communication.
• You will comply with Meta Platform Terms, Developer Policies, and applicable privacy laws.
• You will not misuse, sell, or unlawfully share lead data received through Meta integrations.

6. Acceptable Use

You agree not to:

• Use Relay for illegal, fraudulent, or misleading activities.
• Send spam, unsolicited, or abusive communication.
• Upload harmful code, malware, or unauthorized scripts.
• Attempt to access another user's account or workspace.
• Interfere with the security or performance of the platform.
• Use Relay in violation of any third-party platform policies.

7. Subscription, Fees & Payments

Relay may be offered through free, trial, paid, or custom subscription plans.

Fees, billing cycles, and payment terms will be communicated separately based on the selected plan or agreement.

Failure to make timely payments may result in suspension or termination of access to the platform.

8. Service Availability

We aim to keep Relay available and reliable; however, we do not guarantee uninterrupted, error-free, or always-available service.

The platform may be temporarily unavailable due to maintenance, updates, technical issues, third-party service failures, or events beyond our control.

9. Third-Party Services

Relay may connect with third-party platforms such as Meta, website forms, email services, hosting providers, analytics tools, and communication services.

We are not responsible for changes, downtime, data issues, policy changes, or failures caused by third-party services.

Users are responsible for maintaining secure passwords, managing workspace access, and ensuring that only authorized team members use the platform.

11. Account Suspension or Termination

We may suspend or terminate access to Relay if:

• You violate these Terms & Conditions.
• You misuse the platform or third-party integrations.
• Your activities create legal, security, or operational risk.
• Required payments are not completed.
• We are required to do so by law or platform policy.

12. Limitation of Liability

Relay is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Markmydigi Technologies shall not be liable for indirect, incidental, consequential, special, or business losses, including loss of profits, leads, revenue, data, goodwill, or business opportunities.

13. Indemnification

You agree to indemnify and hold harmless Markmydigi Technologies from any claims, damages, losses, liabilities, or expenses arising from your use of Relay, violation of these Terms, misuse of lead data, or breach of applicable laws or third-party policies.

14. Privacy

Your use of Relay is also governed by our Privacy Policy and Data Deletion Instructions.

15. Changes to Terms

We may update these Terms & Conditions from time to time. Updated terms will be posted on this page with a revised effective date.

Continued use of Relay after changes means you accept the updated Terms.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes shall be subject to the jurisdiction of courts located in Pune, Maharashtra, India.
